Synthetic Media & Identity Policy
1. Purpose
Contia provides AI-powered face swap, head swap, and character swap features that enable users to create synthetic media incorporating the likeness of identifiable persons. These features offer powerful creative and commercial capabilities, but they also carry significant risks of misuse. This Synthetic Media & Identity Policy (“Policy”) establishes the special rules, restrictions, and responsibilities that govern the use of these identity-related features on the Contia platform.
This Policy is issued by Contia (“Contia,” “we,” “us,” or “our”) and supplements our Terms of Service and Acceptable Use Policy (“AUP”). Capitalized terms not defined herein have the meanings ascribed to them in the Terms of Service. By using Contia's identity-swap features, you agree to comply with this Policy in addition to all other applicable Contia policies.
2. Definitions
The following definitions apply throughout this Policy:
- “Synthetic Media”means any image, video, audio, or other media that has been created or altered using artificial intelligence or machine learning techniques such that it depicts events, appearances, speech, or actions that did not occur as depicted. For the purposes of this Policy, Synthetic Media includes all outputs produced by Contia's face swap, head swap, and character swap features.
- “Identity Image”(also referred to as a “source image” or “reference face”) means any image uploaded to Contia that contains the face, head, or other identifiable features of a person, and that is used as the source of the likeness to be transferred onto a target. The Identity Image provides the facial features, expressions, or appearance characteristics that will be applied during the swap operation.
- “Target Image”(also referred to as a “base image” or “destination image”) means any image or video frame onto which the likeness from an Identity Image is applied. The Target Image provides the body, pose, scene, context, or background into which the swapped likeness is composited.
- “Swap Output” means the final image, video, or other media file produced by Contia after applying an Identity Image to a Target Image. The Swap Output is a form of Synthetic Media and is subject to all rules in this Policy.
3. Consent Requirement
Before using the face, head, or likeness of any identifiable person as an Identity Image on Contia, you must obtain verifiable consent from that person (or, in the case of a deceased person, from their estate or authorized representative, where applicable). Consent must meet the following requirements:
- Informed. The person whose likeness will be used must be informed of the specific nature of the use, including that their face or likeness will be digitally swapped onto another image or video, the general context or purpose of the Swap Output, and the intended distribution channels (e.g., social media, commercial advertising, internal use).
- Voluntary. Consent must be freely given, without coercion, undue influence, or deception. Consent obtained through fraud, misrepresentation of the intended use, or exploitation of a power imbalance is not valid.
- Verifiable. You must be able to demonstrate that consent was obtained if requested by Contia, law enforcement, or the person whose likeness was used. Acceptable forms of verification include, but are not limited to: a signed written consent form, an email or text message exchange clearly evidencing consent, a recorded verbal consent, or a digital consent mechanism that captures the identity and affirmative action of the consenting party.
- Revocable.The person whose likeness is used retains the right to revoke consent at any time. Upon receiving notice of revocation, you must promptly cease using the relevant Identity Image and make reasonable efforts to remove or cease distribution of any Swap Outputs incorporating that person's likeness.
- Scope-limited.Consent obtained for one specific use does not extend to materially different uses. For example, consent to use a person's likeness in a product demonstration video does not authorize the use of the same likeness in unrelated commercial advertising or satirical content.
4. Self-Use Exception
If you are using your own likeness as the Identity Image, you are not required to obtain consent from any third party. You represent and warrant that the Identity Image is in fact your own likeness and that you are the person depicted. Contia reserves the right to request verification of your identity if there is a reasonable basis to believe that an Identity Image purported to be a self-portrait is in fact the likeness of another person.
Even when using your own likeness, you remain bound by all other provisions of this Policy, including the prohibitions in Section 5 and the labeling guidance in Section 6. The self-use exception does not permit the creation of Swap Outputs that impersonate other individuals, depict illegal activity, or otherwise violate this Policy or the AUP.
5. Prohibited Uses
The following uses of Contia's identity-swap features are strictly prohibited, regardless of whether consent has been obtained:
5.1 Non-Consensual Sexual or Intimate Content
You must not use Contia to create Synthetic Media that depicts any person in a sexual, sexually suggestive, nude, or intimate context without that person's explicit, informed consent specifically for that depiction. This prohibition applies regardless of whether the Identity Image itself is non-sexual in nature. The creation of non-consensual intimate imagery (sometimes referred to as “deepfake pornography”) is one of the most serious violations of this Policy and will result in immediate, permanent account termination and referral to law enforcement.
5.2 Impersonation or Fraud
You must not use Contia to create Synthetic Media for the purpose of impersonating another person with the intent to deceive, defraud, or mislead. This includes creating Swap Outputs that are presented as authentic depictions of a real person saying or doing something they did not say or do, for purposes including but not limited to: financial fraud, identity theft, social engineering attacks, false endorsements, or gaining unauthorized access to accounts, services, or information.
5.3 Political Disinformation
You must not use Contia to create Synthetic Media that misrepresents the statements, actions, or positions of political figures, candidates, or public officials with the intent to mislead voters, manipulate public opinion, interfere with elections, or undermine democratic processes. This includes creating fabricated speeches, endorsements, debates, or events involving political figures, as well as altering authentic political content in misleading ways.
5.4 Harassment, Bullying, and Intimidation
You must not use Contia to create Synthetic Media that is designed to harass, bully, intimidate, humiliate, or threaten any individual. This includes placing a person's likeness into degrading, embarrassing, or threatening scenarios, creating content intended to damage a person's reputation, or distributing Swap Outputs to the depicted person or their associates with the intent to cause emotional distress.
5.5 Content Involving Minors
You must not use the likeness of any person under the age of eighteen (18) as an Identity Image, and you must not create Swap Outputs that depict minors in any context. This prohibition is absolute and applies regardless of the nature of the content, the intent of the user, or whether consent has been obtained from the minor's parent or guardian. For the avoidance of doubt, you must not use historical or childhood photographs of any person (including yourself) if the person depicted in the photograph appears to be under eighteen (18) years of age.
If Contia detects or receives a report that identity-swap features have been used in connection with the likeness of a minor, the matter will be immediately referred to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement authorities.
5.6 Creating False Evidence
You must not use Contia to create Synthetic Media for the purpose of fabricating evidence for use in legal proceedings, insurance claims, regulatory inquiries, internal investigations, academic proceedings, or any other context where the Swap Output would be presented as an authentic, unaltered depiction of real events. The creation of false evidence may constitute a criminal offense in many jurisdictions, and Contia will cooperate fully with law enforcement investigations into such activity.
6. Labeling and Disclosure
Contia strongly encourages and may, depending on applicable law, require you to disclose the AI-generated nature of Swap Outputs when distributing them. Specifically:
- Public distribution. When publishing or distributing Swap Outputs to any audience, you should clearly and conspicuously disclose that the content was created or altered using AI. Acceptable disclosure methods include visible watermarks, captions, hashtags (e.g., #AIGenerated, #SyntheticMedia), metadata tags, or accompanying written statements.
- Commercial use. When using Swap Outputs in commercial contexts (including advertising, marketing, product listings, or sponsored content), you should ensure that the AI-generated nature of the content is disclosed in a manner consistent with applicable advertising standards, FTC guidelines, and platform-specific policies.
- Regulatory requirements. Certain jurisdictions have enacted or are enacting laws that require specific disclosures for AI-generated or manipulated media. You are solely responsible for understanding and complying with all applicable labeling and disclosure requirements in the jurisdictions where you create, distribute, or target your Swap Outputs.
Contia may embed metadata, digital watermarks, or other provenance signals into Swap Outputs to support content authenticity and provenance tracking. You must not remove, alter, or obscure any such provenance signals.
7. Record-Keeping
You should maintain records sufficient to demonstrate your compliance with this Policy, including:
- Records of consent obtained from each identifiable person whose likeness was used as an Identity Image, including the date consent was obtained, the identity of the consenting party, the scope of the consent granted, and the method by which consent was verified.
- Records of the intended purpose and distribution channels for each Swap Output created, sufficient to demonstrate that the use was within the scope of the consent obtained.
- Records of any consent revocations received, along with documentation of the steps taken to cease use and distribution of affected Swap Outputs.
You should retain these records for a minimum period of three (3) years from the date of creation of the relevant Swap Output, or for such longer period as may be required by applicable law. Contia may request access to these records at any time for the purpose of verifying compliance with this Policy, and you agree to provide them promptly upon request.
8. Enforcement
Violations of this Policy are treated with the utmost seriousness. Contia's enforcement approach for Policy violations is as follows:
- Immediate suspension.Upon detection or receipt of a credible report of a violation of this Policy, Contia may immediately suspend the offending user's access to identity-swap features and, if warranted, to the entire Contia platform, pending investigation. Contia is not required to provide prior notice before suspending access.
- Investigation. Contia will investigate the reported violation, which may include reviewing the Identity Images, Target Images, Swap Outputs, and account activity of the user in question. During the investigation, the suspension will remain in effect.
- Permanent termination.If the investigation confirms a violation of this Policy, Contia may permanently terminate the user's account. For violations of Sections 5.1 (Non-Consensual Sexual or Intimate Content) and 5.5 (Content Involving Minors), permanent termination is the presumptive enforcement action.
- Law enforcement referral. For serious violations, including but not limited to violations of Sections 5.1, 5.2, 5.5, and 5.6, Contia will refer the matter to appropriate law enforcement authorities and will cooperate fully with any resulting investigation. Contia may preserve and produce account data, content, and usage logs as required by law or as necessary to support the law enforcement investigation.
- Content removal.All Swap Outputs, Identity Images, and related content found to violate this Policy will be permanently deleted from Contia's systems, subject to any legal preservation obligations.
The enforcement provisions of our Acceptable Use Policy apply in addition to the provisions of this Section 8.
9. Platform Rights
Contia reserves the following rights in connection with its identity-swap features and the enforcement of this Policy:
- Automated review. Contia may deploy automated systems, including AI-based classifiers, facial recognition technology, content moderation models, and hash-matching systems, to detect potential violations of this Policy. These systems may analyze Identity Images, Target Images, Swap Outputs, and associated metadata before, during, or after the generation process.
- Manual review. Contia may conduct manual review of Identity Images, Target Images, Swap Outputs, and account activity, either proactively or in response to reports, automated flags, or law enforcement requests. Manual review may be performed by Contia employees, contractors, or authorized third-party trust and safety partners, all of whom are bound by confidentiality obligations.
- Content removal without notice. Contia may remove, disable access to, or refuse to generate any Identity Image, Target Image, or Swap Output at any time and for any reason, without prior notice to the user, if we reasonably believe that the content violates or may violate this Policy, the AUP, our Terms of Service, or applicable law.
- Feature modification. Contia may modify, restrict, or discontinue any identity-swap feature at any time, including imposing additional technical safeguards, consent verification mechanisms, or usage limitations, without prior notice.
- Cooperation with platforms and rights holders. Contia may cooperate with social media platforms, content distribution networks, rights holders, and industry organizations to identify and remove Swap Outputs that violate this Policy, including by sharing hashes, metadata, or other identifiers necessary to facilitate takedowns across platforms.
10. Liability
You assume full responsibility and liability for all Swap Outputs created using your Contia account, including any Swap Outputs created by team members within your workspace. Specifically:
- User responsibility.You are solely responsible for ensuring that your use of Contia's identity-swap features complies with this Policy, the AUP, our Terms of Service, and all applicable laws and regulations. Contia provides tools; you determine how those tools are used, and you bear the legal and ethical consequences of that use.
- Indemnification.You agree to indemnify, defend, and hold harmless Contia, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your creation, distribution, or use of Swap Outputs, including but not limited to claims of defamation, invasion of privacy, violation of rights of publicity, intellectual property infringement, or emotional distress.
- No warranty. Contia does not warrant that its identity-swap features will produce outputs that comply with applicable law, are free from bias, or are suitable for any particular purpose. Contia disclaims all warranties, express or implied, with respect to Swap Outputs, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Limitation of liability. To the maximum extent permitted by applicable law, Contia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of identity-swap features or Swap Outputs, regardless of the theory of liability and even if Contia has been advised of the possibility of such damages.
- Third-party claims. If a third party brings a claim against you arising out of a Swap Output you created, Contia is not a party to that dispute and assumes no liability. You are responsible for resolving any such claims at your own expense.
