Acceptable Use Policy
1. Purpose and Scope
This Acceptable Use Policy (“AUP”) sets out the rules that govern your use of the Contia platform, including all websites, APIs, applications, tools, and services provided by Contia (“Contia,” “we,” “us,” or “our”). This AUP applies to all users of Contia, including individual account holders, team workspace members, API consumers, and any person or entity that accesses or uses Contia in any capacity.
This AUP supplements our Terms of Service and is incorporated by reference into those terms. Capitalized terms not defined herein have the meanings ascribed to them in the Terms of Service. By accessing or using Contia, you agree to comply with this AUP. If you do not agree, you must not use Contia.
We may update this AUP from time to time. Material changes will be communicated via email or in-app notification at least thirty (30) days before they take effect. Your continued use of Contia after the effective date of any update constitutes acceptance of the revised AUP.
2. Prohibited Content
You may not use Contia to create, upload, store, distribute, or otherwise make available any content that:
- Illegal material. Violates any applicable local, state, national, or international law or regulation, including but not limited to export control laws, sanctions regulations, and consumer protection statutes.
- Child sexual abuse material (“CSAM”). Depicts, promotes, or facilitates the sexual exploitation or abuse of minors in any form, whether real, digitally generated, or simulated. Contia maintains a zero-tolerance policy toward CSAM. Any detected or reported instances will be immediately referred to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement authorities.
- Copyright infringement. Infringes, misappropriates, or otherwise violates the intellectual property rights of any third party, including copyrights, trademarks, trade secrets, patents, or rights of publicity. This includes uploading copyrighted reference images without authorization, generating content that substantially reproduces protected works, or using Contia to circumvent digital rights management protections.
- Malware and malicious code. Contains, distributes, or is designed to facilitate viruses, worms, Trojan horses, ransomware, spyware, adware, or any other malicious software or code, including scripts intended to disrupt, disable, or gain unauthorized access to any computer system or network.
- Spam and unsolicited communications. Is unsolicited bulk messaging, commercial spam, phishing attempts, or any content designed to deceive recipients into disclosing personal information, credentials, or financial data.
- Harassment and hate speech. Targets, threatens, intimidates, demeans, or harasses any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic. This includes doxxing, coordinated harassment campaigns, and the creation of content intended to humiliate or degrade.
- Threats of violence. Contains credible threats of physical violence against any individual, group, or organization, or promotes, incites, or glorifies acts of terrorism, mass violence, or self-harm.
3. Prohibited Activities
In addition to the content restrictions above, you may not engage in any of the following activities:
- Unauthorized access. Attempting to gain unauthorized access to Contia systems, infrastructure, accounts belonging to other users, or any connected third-party services. This includes exploiting vulnerabilities, brute-force attacks, credential stuffing, session hijacking, or any other method of circumventing authentication or authorization controls.
- API abuse. Using the Contia API in a manner that is excessive, abusive, or outside the scope of your subscription plan. This includes sending requests at a volume or frequency that degrades service quality for other users, using the API for automated monitoring or surveillance purposes, or integrating the API into systems that amplify harmful content.
- Rate limit circumvention. Bypassing, evading, or attempting to circumvent any rate limits, usage quotas, concurrency limits, or other technical restrictions imposed by Contia. This includes rotating API keys, using multiple accounts, employing proxy networks, or any other technique designed to exceed your authorized usage allocation.
- Reverse engineering. Decompiling, disassembling, reverse engineering, or otherwise attempting to derive the source code, algorithms, model weights, training data, or underlying architecture of Contia or any of its component systems, except to the extent expressly permitted by applicable law notwithstanding this restriction.
- Scraping third-party platforms.Using Contia in conjunction with tools, scripts, or automated processes to scrape, crawl, harvest, or collect data, images, videos, or other content from third-party platforms or websites in violation of those platforms' terms of service, robots.txt directives, or applicable law.
- Creating competing services. Using Contia, its outputs, its API, or any data derived from the platform to build, train, or improve a product or service that competes with Contia, or to benchmark Contia against competing products for the purpose of public comparison without our prior written consent.
4. User-Uploaded Content
Contia enables you to upload reference images, prompts, and other content (“User Content”) for use in AI-powered generation workflows. By uploading User Content to Contia, you represent and warrant that:
- You own or have obtained all necessary rights, licenses, consents, and permissions to upload and use the User Content on Contia, including the right to grant Contia the licenses described in our Terms of Service.
- The User Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or any other rights of any third party.
- Where User Content contains the likeness of any identifiable person, you have obtained that person's informed, verifiable consent for the specific use intended, in accordance with our Synthetic Media & Identity Policy.
- The User Content complies with all applicable laws and regulations, including privacy and data protection laws in the jurisdiction where the content was created and where the identifiable individuals reside.
Contia does not claim ownership of your User Content. However, you acknowledge that Contia may process User Content as necessary to provide the service, including temporary storage, transformation, transmission to third-party AI providers, and caching for performance purposes.
5. AI-Generated Content
Contia uses artificial intelligence models to generate images, videos, and other media (“Generated Content”) based on your prompts, reference images, and configuration settings. You acknowledge and agree that:
- Review before distribution.You are solely responsible for reviewing all Generated Content before distributing, publishing, or otherwise making it available to any third party. AI models may produce unexpected, inaccurate, biased, or otherwise objectionable outputs. You must not distribute Generated Content that violates this AUP, our Terms of Service, or applicable law, regardless of whether the violation resulted from your input or from the AI model's autonomous generation.
- No guarantee of accuracy. Contia does not guarantee the accuracy, completeness, quality, legality, or suitability of any Generated Content. Generated Content should not be relied upon as factual, and Contia disclaims all liability for errors, omissions, or harmful outputs.
- Compliance responsibility. You are responsible for ensuring that your use of Generated Content complies with all applicable laws, regulations, industry standards, and third-party rights, including intellectual property rights, rights of publicity, and data protection requirements.
- No exclusivity. Due to the nature of AI generation, similar or identical outputs may be generated for other users who provide similar inputs. Contia does not guarantee that Generated Content is unique.
6. Synthetic Media
Contia offers face swap, head swap, and character swap features that create synthetic media incorporating the likeness of identifiable persons. The use of these features is subject to additional rules and restrictions set forth in our Synthetic Media & Identity Policy, which is incorporated by reference into this AUP.
All users of Contia's identity-swap features must read, understand, and comply with the Synthetic Media & Identity Policy before using those features. Violations of the Synthetic Media & Identity Policy are treated as violations of this AUP and may result in the enforcement actions described in Section 9 below, including immediate account suspension or termination.
7. Team and Workspace Misuse
Contia supports team workspaces that allow multiple authorized users to collaborate under a shared account. You agree to the following rules governing team and workspace usage:
- Credential sharing prohibited. Access credentials (including passwords, API keys, session tokens, and authentication cookies) are personal to each authorized user and must not be shared, transferred, or made available to any other person. Each team member must authenticate with their own unique credentials.
- Team member limits. Your subscription plan specifies the maximum number of team members permitted in each workspace. You must not exceed this limit by sharing credentials, rotating users through a single seat, or any other means. If you need additional seats, you must upgrade your plan or purchase additional seats through the platform.
- Workspace administrator responsibility. Workspace administrators are responsible for ensuring that all team members comply with this AUP, our Terms of Service, and all applicable laws. Workspace administrators should promptly remove team members who violate these policies and report violations to Contia.
- Credit misuse. Credits allocated to a workspace are for use by authorized team members in accordance with the applicable subscription plan. You must not transfer, sell, barter, or otherwise redistribute credits outside of the workspace to which they were allocated, or use automated systems to consume credits in a manner inconsistent with normal human-directed usage.
8. Reporting Violations
If you become aware of any content or activity on Contia that you believe violates this AUP, our Terms of Service, or applicable law, we encourage you to report it promptly. You may submit reports by emailing legal@contia.app with the following information:
- Your name and contact information.
- A description of the content or activity you believe is in violation.
- The URL, job ID, asset ID, or other information sufficient to locate the content or identify the activity.
- An explanation of why you believe the content or activity violates this AUP, including the specific section(s) you believe are implicated.
- If the report relates to intellectual property infringement, please follow the procedures described in our Takedown Policy.
We review all reports promptly and will take appropriate action in accordance with Section 9 below. We may contact you for additional information during our investigation. We will not retaliate against any user who submits a report in good faith.
9. Enforcement
Contia reserves the right to investigate any suspected violation of this AUP and to take any action we deem appropriate. Our enforcement process generally follows the steps below, though we reserve the right to skip or combine steps at our discretion depending on the severity and nature of the violation:
- Investigation. Upon receiving a report or detecting a potential violation through automated monitoring, manual review, or other means, we will investigate the matter. During the investigation, we may temporarily restrict access to the account or content at issue.
- Warning. For first-time or minor violations, we may issue a written warning specifying the nature of the violation and the corrective action required. You will be given a reasonable period to come into compliance.
- Suspension. For repeated violations, serious violations, or failure to comply with a prior warning, we may suspend your account, workspace, or API access for a specified period. During suspension, you will not be able to access Contia or any content stored on the platform. Credits are not refunded for suspension periods.
- Termination. For severe violations, persistent non-compliance, or violations that pose a risk of harm to Contia, its users, or third parties, we may permanently terminate your account, workspace, or API access. Upon termination, all content associated with your account may be deleted. Credits are not refunded upon termination for cause.
- Content removal. At any stage, we may remove, disable access to, or refuse to distribute any content that we reasonably believe violates this AUP, without prior notice to you.
We will endeavor to notify you of enforcement actions and provide an opportunity to respond, except where doing so would compromise an investigation, endanger any person, or where we are legally prohibited from doing so.
10. Cooperation with Law Enforcement
Contia cooperates with law enforcement authorities in accordance with applicable law. We may disclose your account information, User Content, Generated Content, usage logs, IP addresses, and other data to law enforcement authorities when:
- We are required to do so by a valid legal process, including subpoenas, court orders, search warrants, or other lawful requests from government authorities.
- We have a good-faith belief that disclosure is necessary to prevent imminent bodily harm, death, or significant damage to property.
- We have a good-faith belief that the account or content at issue involves the sexual exploitation of minors, in which case we will report the matter to the National Center for Missing & Exploited Children (NCMEC) in accordance with applicable law.
- We have a good-faith belief that disclosure is necessary to prevent or detect fraud, security incidents, or other illegal activity on our platform.
We will notify users of law enforcement requests for their data unless we are legally prohibited from doing so or where notification would jeopardize an investigation or endanger any person.
Nothing in this AUP limits Contia's ability to pursue any legal remedies available to it, including seeking injunctive relief, damages, or other relief in connection with violations of this AUP.
